OUTFITTER AND GUIDE RELEASE OF LIABILITY AND USER INDEMNITY AGREEMENT

I, ______________________________ ,(client) hereby acknowledge that I have voluntarily applied and contracted to participate in the sport or activity of hunting from a primitive camp, with equipment and/or services to be provided by LOST SOLAR OUTFITTERS, LLC., (Outfitter). By my initials hereon and at each place hereafter marked (INITIAL,______). I have signified my agreement with and acceptance of the terms, statements and conditions herein.

 I UNDERSTAND AND AGREE that the described sport or activity and all other hazards and exposures connected with the activities conducted in the outdoors do involve risk and that I am cognizant of the risks and dangers inherent with hunting and camping, and in particular in the mountains of Colorado, and that I and/or my family, including any minor children, are fully capable of participating in the activities contracted for and willingly assume the risk of injury as my responsibility, including loss of control or balance in walking or climbing, use of firearms, use of animals, weather, collision with trees, rocks, and other man made or natural obstacles, whether they are obvious or not obvious. I UNDERSTAND AND AGREE that accidents or illness can occur in remote places without medical facilities, physician or surgeon, and that the availability of such facilities or persons may be further limited by weather conditions which may or may not be normal or expected, and that I may have exposure to temperatures or inclement weather and in consideration of and as part payment of the right to participate in the activities associated with hunting from a primitive camp and any other activities including the services of food that may be arranged for me/or my family by the outfitter and its agents. I do hereby agree that myself and my family (including minor children) are in good health and are able to handle the hazards or traffic, weather conditions, exposure to animals, walking, riding of animals, and utilization of equipment whether furnished by me or by the outfitter, associated with the activities specified and all related activities.  I UNDERSTAND AND AGREE that any route or activity, chosen as part of the hunting trip in which I and /or my family am participating may not be the safest but has or will be chosen for its interest, challenge, or best meeting the goals of the services for which I am contracting. Should animals ever be used or are present as part of our activities, I and my family understand that an animal, irrespective of its training and usual past behavior and characteristics, may act or react unpredictably at times based upon instinct or fright which likewise is an inherent risk to be assumed by each participant in the activity.  AS LAWFUL CONSIDERATION for being permitted by outfitter to participate in the referenced activities, I do hereby RELEASE FROM ANY LEAGAL LIABILITY, AGREE NOT TO SUE, CLAIM AGAINST, ATTACH THE PROPERTY OF OR PROSECUTE AND FURTHER AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS the Outfitter, the United States Forest Service or Parks Department, and government agency whose property and activity scheduled may be required to utilize and of all of their officers, members, organizations, agents and employees for any injury or death caused by or resulting from my participation in the activities described above, WHETHER OR NOT SUCH INJURY OR DEATH WAS CAUSED BY THEIR NEGLENCE OR FROM ANY OTHER USE. WILDERNESS REGULATIONS

 

LOST SOLAR OUTFITTERS, LLC. (Colorado Outfitters Registration Number 2215), operates under a special use permit from the Forest Service, USDA. Our camps are located in the FLAT TOPS WILDERNESS area of the WHITE RIVER NATIONAL FOREST. It is our responsibility to inform our guests of the rules and regulations governing wilderness use. We should always be concerned about having the lowest possible environmental impact. Your cooperation is greatly appreciated.

 •     The use of motorized vehicles or equipment is prohibited. This includes chain saws and generators.

 •     Hay or straw will not be permitted for bedding or livestock feed. Only cubed/pelleted feed and grain will be used to feed livestock.

 •     The use of nails, screws, tacks or bolts in live trees is prohibited. Rope, wire or other fastening devices, including nails in dead trees or poles must be removed when leaving the campsite. Do your best to obliterate any site modifications.

 •     Only dead or down timber may be used for firewood. Green trees and branches may not be cut.

 •     Use a pit-type toilets are mandatory. Waste will be covered with at least 6 inches of soil.

 •     A pit will be used for leftover food, dishwater and wash water. All other trash non burnable refuse) will be packed out.

 •     If horses are used in your camp, they must be kept at least 100 feet from lakes or streams. Do not tie horses to green trees. Do not over-graze. Move picket lines, rope corrals and portable fences often.

 •     Scatter manure piles in heavy deposition areas or in areas of concentrated use.

 * Do not trench tent perimeter.

 • If a campfire is necessary, make a small pit fire without rocks around it. Do not build rock fire rings. Rocks and soil are easily scarred by fire. Erase all signs of fire when you leave.

 •     Wash at least 100 feet from lakes and streams. Use a biodegradable soap.

 In the past, the question was, "Man's survival in the wilderness", now it is a question of the "Wilderness surviving man". Let us do our share.

 YOU CAN'T CHEAT THE MOUNTAINS

HIGH ALTITUDE HEALTH HINTS

The key to proper body management is to stay well hydrated, well fed and well dressed. Listen to your body. You can't cheat the mountains. Most people experience no difficulty at our high altitude. But, it's best to be knowledgeable and arrive prepared.

 DEHYDRATION

Dehydration is the most common problem associated with visitors to the high country. Because of our dry climate, (mountain air has a very low moisture content), faster breathing rate, and high activity level of people visiting our camps, loss of body fluids can quickly become significant. People are frequently unaware of the onset of dehydration. A "rule of thumb" is to drink at least 6 - 8 glasses of water per day. Substantially more if your activity level is high. Many mild symptoms frequently resolve with just an increase in fluid intake. When you feel a headache coming on, reach for your water bottle before shaking out a couple of Advil. Electrolyte replacement drinks, such as Gatorade, Recharge, etc., are also beneficial. REMEMBER : Alcohol and food digestion requires water.

 SUN AND UV PROBLEMS:

The atmosphere acts as a filter for the harmful rays that the sun emits. At our camps we have less filter than you may be used to. Though we call it snow blindness, (sunburn to the eyes), it can occur all year round. Most people describe the pain as "like having sand in your eyes." Be certain that your eyewear offers total UV protection. The same problems can also affect your skin. You will burn more easily and quickly. A high SPF sun block will provide adequate protection.

 NOSEBLEEDS:

Due to the dryness of the air, some people experience nosebleeds. Because blood vessels in the nose are very near the surface, they become dry, brittle and occasionally crack causing a nosebleed. Drinking lots of water helps to avoid this. If you develop a nosebleed,, pinch your nose about half way up and lean forward for about 10 to 15 minutes.

 CLOTHING:

Start with a good base layer such as Capiline, polypropylene or silk underwear. These fabrics help wick body moisture away from your skin and into the insulating layer(s). Your insulating layer(s) is usually made up of fibers such as wool or polar fleece. Top it off with a waterproof breathable shell to protect you against the elements. "Layering when you venture out also improves your comfort dramatically.

 HYPOTHERMIA:

In summer or winter hypothermia can sneak up on the unprepared mountain traveler. It is not unusual with the passing of a thunderstorm, snowstorm or the onset of nightfall for the temperatures to drop as much as 40 degrees F. Even in the moderate temperatures (50 -60 degrees F.) hypothermia is a risk, especially if one becomes wet from heavy exertion or rainfall or wind-chill becomes a factor. "Expect the unexpected." Mountain weather can change quickly and unexpectedly. An extra layer of warmth and adequate foul weather gear is only a little added weight to your back or fanny pack.

 FROSTBITE:

Frostbite can occur when the air temperature falls below 32 degrees F., and skin is exposed for prolonged periods of time. Wind will speed the process. Keep skin covered. Be aware of the possibility of frostbite of the hands, feet, ears and nose. Do not rub the affected part and if there is a chance of re-freezing, do not thaw the affected part.

 ALTITUDE ILLNESS OR ACUTE MOUNTAIN SICKNESS:

Most people are completely unaffected by the altitude at our camps. A few may experience a range of symptoms that we refer to as Acute Mountain Sickness, (AMS) or Altitude Illness. Symptoms may include shortness of breath, lightheadedness, headache. difficulty sleeping (including frequent wakening and strange dreams), dizziness, nausea, decreased appetite, fatigue, swelling and others. Symptoms usually appear in the first 24 hours after arrival at altitude. They typically last for a day or two. To help your body acclimatize, take it easy for the first day or two and arrive in the best physical shape possible.

 Excessive alcohol should be avoided as well as non-essential prescription narcotics and barbiturates. Drink lots of water each day. Dehydration is a common cause of worsening AMS. Include lots of high carbohydrate foods in your diet. Avoid foods that are difficult to digest, (fats and proteins). Reduce caffeine and salt consumption.
